Liens and the Collection Process

A lien is a legal claim filed with the Office of the Minnesota Secretary of State or county recorder. We may file a lien at any time when an individual or business owes a debt to the state. 

A l ien allows  us to take real property (land and any permanent buildings, fixtures, or improvements on that land) or personal property (movable property, such as vehicles, furniture, boats, and collectibles) owned by an individual or business in Minnesota to pay your debt.

Liens extend the time we can take action to resolve your debt to 10 years. For more information, see Statute of limitations .  Once a lien is recorded, it becomes public information.

Minnesota law requires us to add a $30 fee to the debt of the taxpayer for filing and releasing each lien. ( See Minnesota Statutes, section 270C.63  and  section 16D.08 ). 

We will release the lien when the debts on the lien are paid in full with  secured funds . If you pay any other way, we will release the lien 30 days from the day we receive your payment.

We cannot file a lien on your property when you are in bankruptcy . A bankruptcy extends the time in which we can file a lien for debts that are not discharged. It does not extend the time to renew liens that were filed before the bankruptcy.

No. However, anyone can search public records to locate recorded liens, including credit bureaus.

If you believe we filed a lien in error, you may request an Administrative Review. If we determine it was filed in error, we will release the lien.

You may request a lien subordination or partial lien release if it will help resolve the balance due. If approved, you are still liable for your debts and the collection process will continue.

Lien Subordination

Primarily for mortgage refinancing, a lien subordination puts a new mortgage or UCC1 document at a higher priority than our lien. Our lien stays attached to the property.

Partial Lien Release

If you want to sell real or personal property and proceeds of the sale will not be enough to pay off your lien, you may ask for a partial lien release. A partial release detaches our lien from your property, but it stays attached to you until the debt is paid in full.

Definitions

  • Real property: Land and any buildings or permanent structures, like your house.

Personal property: Movable property that is not attached to the land.

What is the Process?

Submit your request in writing for:

  • Lien subordination
  • Partial Lien Release on real property

Partial lien release on personal property

We will contact you within two weeks of receiving your application with more information.

We may continue to take collection actions while we consider your request.

Our Determination

If we accept your request, we'll release or subordinate our lien after we receive the payment amount listed on the commitment letter and closing documents.

If we deny your request, we'll send you a denial letter. Our liens remain attached to your property until the balance is paid in full. We may deny your request if:

  • There is enough equity in the property to pay off the attached liens
  • The subordination or partial lien release will not help resolve the balance due

The application is missing documents

We must file a lien within five years of the assessment date . If your debt is the result of a Commissioner Filed Return (CFR) , that period begins with the date we file the CFR.

A lien expires after 10 years. We can renew it before it expires and continue to take  collection actions .

These time limits are part of Minnesota Statute 270C.63, subdivision 9 .

  • A lien attaches to all proceeds if you sell your property.
  • If you die, the property becomes part of your estate. A lien remains attached to the property.
  • If there are multiple owners, the lien only affects the person whose name is on the lien.
  • If you own as a joint tenant, and the other joint tenant dies, the lien on the deceased owner ends.
  • If you own as tenants in common, and the other tenant dies, their share of the property goes to the heirs. The lien remains attached to the property.

We transcribe (copy) a lien between one county and another county, or between a county and the Office of the Minnesota Secretary of State (OSS) if:

  • You move to a new county 
  • We find real property in another county 

A transcription may be filed within ten years of the original filing date. It does not extend the statute of limitations.

580.24 REDEMPTION BY CREDITOR.

(a) If no redemption is made by the mortgagor, the mortgagor's personal representatives or assigns, the most senior creditor having a legal or equitable lien upon the mortgaged premises, or some part of it, subsequent to the foreclosed mortgage, may redeem within seven days after the expiration of the redemption period determined under section 580.23 or 582.032 , whichever is applicable; and each subsequent creditor having a lien may redeem, in the order of priority of their respective liens, within seven days after the time allowed the prior lienholder by paying the amount required under this section. However, no creditor is entitled to redeem unless, one week or more prior to the expiration of the period allowed for redemption by the mortgagor, the creditor:

(1) records with each county recorder and registrar of titles where the foreclosed mortgage is recorded a notice of the creditor's intention to redeem;

(2) records with each county recorder and registrar of titles where the notice of the creditor's intention to redeem is recorded all documents necessary to create the lien on the mortgaged premises and to evidence the creditor's ownership of the lien, including a copy of any money judgment necessary to create the lien; and

(3) after complying with clauses (1) and (2), delivers to the sheriff who conducted the foreclosure sale or the sheriff's successor in office a copy of each of the documents required to be recorded under clauses (1) and (2), with the office, date and time of filing for record stated on the first page of each document.

The sheriff shall maintain for public inspection all documents delivered to the sheriff and shall note the date of delivery on each document. The sheriff may charge a fee of $100 for the documents delivered to the sheriff relating to each lien. The sheriff shall maintain copies of documents delivered to the sheriff for a period of six months after the end of the mortgagor's redemption period.

(b) Saturdays, Sundays, legal holidays, and the first day following the expiration of the prior redemption period must be included in computing the seven-day redemption period. When the last day of the period falls on Saturday, Sunday, or a legal holiday, that day must be omitted from the computation. The order of redemption by judgment creditors subsequent to the foreclosed mortgage shall be determined by the order in which their judgments were entered as memorials on the certificate of title for the foreclosed premises or docketed in the office of the district court administrator if the property is not registered under chapter 508 or 508A , regardless of the homestead status of the property. All mechanic's lienholders who have coordinate liens shall have one combined seven-day period to redeem.

(c) The amount required to redeem from the holder of the sheriff's certificate of sale is the amount required under section 580.23 . The amount required to redeem from a person holding a certificate of redemption is:

(1) the amount paid to redeem as shown on the certificate of redemption; plus

(2) interest on that amount to the date of redemption; plus

(3) the amount claimed due on the person's lien, as shown on the affidavit under section 580.25 , clause (3).

The amount required to redeem may be paid to the holder of the sheriff's certificate of sale or the certificate of redemption, as the case may be, or to the sheriff for the holder.

Twins take down Royals as Joe Ryan impresses

The Twins played eight great innings of baseball Monday, but a near blunder made things interesting in the ninth inning, resulting in a 6-5 final score.

Joe Ryan started on the bump for the Twins vs. the Royals for a Memorial Day matchup. He was dealing from the first pitch. The second batter he faced Bobby Witt Jr. singled, then he got through 14 straight Royals without allowing a walk or hit.

Minnesota was able to provide some run support in the bottom of the third inning when Jose Miranda hit his fifth home run of the season, driving in Edouard Julien, taking the first lead of the game 2-0.

The home run party picked up again in the bottom of the fifth inning when Trevor Larach launched a 441-foot missle, driving home Juien again and Willi Castro, extending the lead to 5-0.

Kansas City broke Joe Ryan's remarkable 14 retired-batter streak in the the sixth inning. The lead was narrowed to 5-1 after a Vinnie Pasquantino RBI single.

Griffin Jax relieved Ryan after he dealt seven innings, where he allowed only four hits and one earned run while recording nine strikeouts, his second most this season.

An Alex Kirilloff RBI single in the eighth inning extended the score to 6-1. Cole Sands came in to close out the game, but after a Hunter Renfroe RBI double, the Twins looked towards Jhoan Duran to finish things off. With a runner on second and third he hit the first batter he faced, loading the bases.

Then Kansas City found another run, shortening the lead to 6-3, as the bases remained loaded. Two more runs were scored, before Bobby Witt Jr. grounded out to Duran and the game ended 6-5.

The Twins move to 29-24 on the season and they will get back to work tomorrow night for a 6:40 P.M. local time start in game two of a four-game series vs. the Royals.

Twins, frustrated by umpires, fall to guardians on josé ramírez home run off jhoan duran.

CLEVELAND – The boxscore will show the Twins lost their fourth consecutive game Friday, a 3-2 defeat to the Cleveland Guardians after José Ramírez hit a go-ahead solo homer off Jhoan Duran in the eighth inning.

It's the pitches that do not show up in the boxscore that drew the Twins' ire in the final two innings, upset with plate umpire Roberto Ortiz's strike zone.

Willi Castro was called out on strikes in the top of the eighth inning on a slider well off the plate, potentially costing the Twins a run when Kyle Farmer, the next batter, hit a game-tying RBI double. Duran's first two pitches to Ramírez should've been called strikes, according to pitch tracking systems, before his fourth pitch was launched into the right-field seats.

In the ninth inning, Carlos Correa saw his nine-pitch at-bat against Guardians closer Emmanuel Clase end on a called third strike, a 100-mph cutter below his knees.

"It's frustrating for our players when late in the game every meaningful call did go against us," Twins manager Rocco Baldelli said. "The guy that hits the home run — he's hit a lot of big home runs in his career, he's a great player — but when the first two pitches of the at-bat are strikes and they both get called balls, that's hard to swallow."

There was live music playing outside Progressive Field and postgame fireworks were already on the schedule as the Guardians debuted their City Connect uniforms. Ramírez became the life of the party with his homer off Duran, connecting on an inside curveball for his first hit off the Twins closer in seven career at-bats. After Ramírez gestured to his teammates and started his home run trot, the announced crowd of 30,121 joined together to chant his first name.

Duran, who surrendered his first run of the season and only his third hit, says he didn't think too much about the first two pitches of the at-bat that were called balls.

"I don't pay too much attention to that," Duran said. "If he calls a ball, it's a ball. If he calls a strike, it's a strike."

The Twins rallied from a one-run deficit in the top of the eighth inning. After Jose Miranda singled, pinch-runner Austin Martin swiped second base when Castro was called out on strikes on a full-count pitch. Kyle Farmer, pinch-hitting for Edouard Julien when the Guardians brought in lefty reliever Tim Herrin, thumped a two-strike curveball into the left-center gap to tie the score.

After leaving two men on base in the eighth inning, the Twins didn't produce another baserunner. When Correa was called out on strikes, he hopped in the batter's box as teammates yelled from the dugout.

"I've never been tossed out of a game, and maybe there's a situation that would call for it, but I just think their job is too hard for me to be harsh on them," Correa said. "It is what it is. Sometimes, I get calls. Sometimes, I don't. You move on."

The Twins produced only four hits Friday. Alex Kirilloff homered in the third inning, the Twins' first run since the first inning Tuesday, which ended the fourth-longest scoring drought in team history, according to Elias Sports Bureau. The Twins had a 34-inning scoreless streak from 2014-15, and they were one inning shy from matching the longest drought in a single season (1978 and 1964).

"When we get something going, Willi Castro gets rung up on strikes on a clear ball," Baldelli said. "The combination of things, I know there are some guys that are upset in the room and I'm not happy about it either. That's tough to take and in one-run, very tight, low-scoring games, sometimes those things mean especially a lot. Today they ended up coming into play in a big way, unfortunately.

"We've got to play better. If we don't want those things to affect the game, the things I was just referencing, we have to create some separation in the game and then those things don't end up mattering that much."
