Restaurant, commercial space and 136 apartments planned on Route 13 in Smyrna

Plans for a drive-thru restaurant, commercial space and 136 apartments have been proposed on Route 13 in Smyrna across from the Smyrna Rest Area.

Apennine Development of Wilmington has filed a conceptual plan with the town for 9 acres at 5563 and 5573 DuPont Parkway (Route 13 South). The land is mostly farmland but is in the corridor commercial zone.

The plan includes:

  • Eight 3-story apartment buildings, four with 16 units and four with 12 units for a total of 112 units
  • Two 3-story mixed-use buildings, each with 5,670 square feet of commercial space on the first floor and 12 apartments on the second and third floors, so 24 total apartments in the two buildings
  • A single-story 3,000 square-foot clubhouse with fitness center and outdoor pool for apartment residents
  • A single-story 2,400 square-foot drive-thru restaurant
  • Streets, parking, open space and recreational amenities

Along with the pool and clubhouse, the proposed amenities are a dog/pet park and a community garden, but the Smyrna planning staff is recommending a picnic area and/or playground instead of the garden.

The land borders Route 13 on the east, farmland on the west, Filec Electrical Services to the south and homes and Parkview RV Center to the north.

A residential development is planned on the Sharoff farm property to the west, between Route 13 and Duck Creek Road.

To coordinate the main road through the residential neighborhood and this commercial center and apartments, the town planning staff is recommending a wide-entry boulevard from Route 13 with a median through the middle, connecting to the Sharoff property.

“The eventual and ultimate goal of this is to provide a central and bisecting boulevard to connect U.S. Route 13 with Duck Creek Road, and thus funnel residential traffic from the Sharoff farm through this site and directly onto U.S. Route 13 (and vice versa) without clogging Duck Creek Road,” according to the Smyrna planning staff report .

The developer will have to pay to run utilities to the site, said Jeremy Rothwell, Smyrna director of planning.

The commercial buildings including the restaurant must be built within 15 feet of the highway right of way with parking in back, “rather than having a huge sea of parking in front of them along Route 13," Rothwell said.

Landscaping requirements include 132 trees; however, there are already trees on the site that can count in that total. The planning staff recommends that existing mature trees be retained wherever possible if they don't interfere with the proposed building locations.

The staff also recommends a row of evergreen trees be planted along the northern property boundary next to the existing residential lot and house and along the western border with the Sharoff farm since that will likely be next to single-family homes or townhouses that are planned.

When will construction begin?

Apennine Development did not return calls about when construction could start or the names of the restaurant and businesses interested in the development.

Rothwell said the next steps with the town include the preliminary plan and the final plan.

The preliminary plan includes engineering for the stormwater system, utilities, roads, parking and open space.

“There are a few minor tweaks the town staff would have to see,” Rothwell said.

Those include a request for a second entrance/exit because there’s only one access point from Route 13. The second entrance could have removable bollards or posts so regular traffic can’t get through but emergency vehicles could, by removing the posts.

County and state agencies must approve the plan including the Delaware Department of Transportation and State Fire Marshal’s Office .

Rothwell said one concern is temporary ponding on the property after storms throughout the year, likely because of a layer of clay a couple of feet below the surface. The applicant hasn’t included stormwater management ponds in the proposal yet, but those aren’t required for the conceptual plan.

“Presumably, the applicant proposed to place underground bio-retention areas beneath the proposed parking areas for storm water management,” according to the town planning staff’s report. “If soils are not conducive to this, the project may have to be substantially reconfigured and redesigned.”
