This could be for a variety of reasons ranging from personal or family health problems, the birth and/or adoption of a child, to rest from excessive job stress. It could also be the loss of a loved one or the pursuit of a hobby or a desire to travel. A leave of absence in your case is not a luxury, but a necessity.

What is a Leave Application Letter? 

A leave application letter is a letter written to apply for a leave of absence from the office for a certain period.

The concept of a leave application centers around a formal way of asking for a break/leave of absence from work for a specified time period.

A person writes leave application letter they’re unable to perform their duties for a stipulated period of time.

Types of Leave Applications 

  • Sick Leave  

Sick leave is basically a leave of absence due to an illness. Sick leave is granted under a number of scenarios; for personal physical or mental illness, the care of a sick child, spouse, parent, or parent of a spouse, regular health checks, and/or to address the physical, psychological, and legal effects of domestic abuse. 

At the moment, there are no federal legal requirements for paid sick leave. For companies subject to the Family and Medical Leave Act (FMLA), the Act does require unpaid sick leave. The U.S. government ensures that federal employees get 13 paid sick days a year.

  • Study Leave 

Study leave is basically a leave of absence from work granted in order to allow a person time to study or carry out research. In the case of a school pupil, it allows them to study at home, usually in order to prepare for examinations.

According to the labor laws in the US, Study Leave with or without pay is a matter for arrangement entirely between the employer and the employee. By law, the maximum length of study leave granted in the same employer’s service is two years. 

  • Sabbatical 

By definition, a Sabbatical leave is a period in which a person does not report to his regular job but who remains employed with that company. Also commonly referred to as ‘career break’ or ‘adult gap year’, It is a period away from work, agreed with your employer.

The truth is, there are no laws that cover taking a career break or sabbatical; as such employees have no statutory right to take leave. A sabbatical will in most cases be an authorized, unpaid leave of absence.

  • Maternity/Paternity Leave

Maternity leave is basically a period of absence from work that is granted to a mother before and after the birth of her child. The US government doesn’t guarantee for paid maternity leave, employers may, however, provide paid leave if they choose. If you have worked at a company for at least a year, you are entitled by federal law to take up to 12 weeks of unpaid maternity leave.

Paternity leave is a period of time that the father of a new baby is allowed away from work. Usually, a company provides up to eight weeks of paid paternity leave. When a man takes time off because his partner is having a baby, adopting a child or having a baby through a surrogacy arrangement he might be eligible for: 1 or 2 weeks’ paid paternity leave, paternity pay and/or shared parental leave and pay.

  • Vacation/Holiday Request Letter 

Vacation leave is ideally available to all eligible employees for the purpose of rest, relaxation, and to attend to personal affairs. It is strikingly similar to annual leave which is paid time off work granted by employers to employees. Although not stipulated by law, many employers nonetheless offer paid vacation, typically around 10 workdays, to attract employees.

  • Emergency Leave Application 

Emergency leave is necessary to cater to unforeseen circumstances such as the death of a loved one/family member. A funeral leave, which is leave of absence with pay, must not exceed three days and can be granted for absence from work. You qualify for an emergency leave if; there is a verified death, a life-threatening condition due to an accident, illness, or major surgery, or to visit a terminally ill person in the immediate family.

If you are inadmissible to the United States and are seeking an immigrant visa, adjustment of status, certain nonimmigrant statuses, or certain other immigration benefits, you must file this form to seek a waiver of certain grounds of inadmissibility. Please refer to the instructions to determine whether you should use this form.

Through Sept. 30, 2024, there is no fee to file Form I-485, Application to Register Permanent Residence or Adjust Status , on the basis of classification as an Afghan special immigrant, or for any associated biometric services or to file an associated Form I-601.

Through Sept. 30, 2024, there is no fee to file Form I-601 individually with an approved Form I-130, Petition for Alien Relative , filed with USCIS in the United States for an Afghan national (beneficiary) who has a visa immediately available.

You can pay the fee with a money order, personal check, cashier’s check or  pay by credit card or debit card using Form G-1450, Authorization for Credit Card Transactions . If you pay by check, you must make your check payable to the U.S. Department of Homeland Security.

When you send a payment, you agree to pay for a government service. Filing fees are final and non-refundable, regardless of any action we take on your application, petition, or request, or if you withdraw your request.   If you pay by credit card or debit card, you cannot later dispute the payment. Use our Fee Calculator to help determine your fee.

If you are submitting multiple forms, pay each filing fee separately. We are transitioning to electronically processing immigration benefit requests, which requires us to use multiple systems to process your package. We may reject your entire package if you submit a single, combined payment for multiple forms.

Please do not submit this checklist with your Form I-601. The checklist is an optional tool to use as you prepare your form, but does not replace statutory, regulatory, and form instruction requirements. We recommend that you review these requirements before completing and submitting your forms.  Do not send original documents unless specifically requested in the form instructions or applicable regulations.

If you submit any documents (copies or original documents, if requested) in a foreign language, you must include a full English translation along with a certification from the translator verifying that the translation is complete and accurate, and that they are competent to translate from the foreign language into English.

Did you provide the following?

  • Evidence that establishes why you may qualify for a waiver of inadmissibility, which depends on the ground(s) of inadmissibility that apply to you and should include evidence to show why we should grant you a waiver of inadmissibility as a matter of discretion. 
  • If applying for a waiver that requires you to a showing of extreme hardship to a spouse, parent, son, or daughter of a U.S. citizen or lawful permanent resident, you must submit evidence establishing the family relationship and evidence that shows the denial of admission would result in extreme hardship to your qualifying relative.
  • If you are a VAWA self-petitioner seeking a waiver for immigration fraud or misrepresentation, you may show how the denial of admission would result in extreme hardship to your qualifying relatives or yourself. 
  • Evidence to support a waiver for inadmissibility due to a communicable disease of public health significance (if applicable).
  • Evidence to support your request for a vaccination exemption (if applicable).
  • Evidence to support a waiver of inadmissibility due to physical or mental disorder and associated harmful behavior (if applicable).
  • Evidence to support a waiver of criminal grounds of inadmissibility found in INA section 212(a)(2) (if applicable)
  • Evidence to support waiver for immigration fraud or misrepresentation (if applicable).
  • Evidence to support a waiver for inadmissibility because of your membership in a totalitarian party (if applicable).
  • Evidence to support a waiver for inadmissibility due to alien smuggling (if applicable).
  • Evidence to support a waiver of inadmissibility due to being the subject of a civil penalty under INA section 212(a)(6)(F) (if applicable).
  • Evidence to support a waiver of the 3-or 10-year unlawful presence bar under INA section 212(a)(9)(B)(v) (if applicable).
  • If you are a TPS applicant, evidence that a waiver is warranted. 
  • Evidence that you warrant a waiver of inadmissibility based on factors that would be considered if you were seeking consent to reapply if you are seeking adjustment of status under NACARA section 202 or HRIFA section 902, and inadmissible under INA section 212(a)(9)(A) or (C). 
  • Evidence that shows connection between the battery or extreme cruelty that is the basis for the VAWA claim and the self-petitioner’s removal, departure from the United States, reentry or re-entries into the United States, or attempted reentry into the United States if you are an approved VAWA self-petitioner or child of an approved VAWA self-petitioner and inadmissible under INA section 212(a)(9)(C)(i).   
  • Evidence to support waiver if you are an applicant for adjustment of status as a Special Immigrant Juvenile (if applicable).

Most individuals and organizations have to file and pay taxes each year — but that’s not the case if you qualify for tax-exempt status.

Tax-exempt status is common for charitable and religious organizations. Certain nonprofit organizations can complete a tax exemption form so they don’t have to pay income taxes.

While some organizations are eligible for tax exemption, certain criteria must be met to claim the tax exemption.

What does it mean to be tax-exempt.

Tax-exempt status means you don’t have to pay some or all of the taxes you typically have to pay on income or donations received. Certain types of revenue or income may be exempt, while other organizations may be exempt from paying taxes entirely.

Organizations that are eligible for tax-exempt status can file tax exemption forms. Once you’ve made sure you’re exempt from federal taxes, you can apply for tax-exempt status at the state and local levels.

While many nonprofit organizations are eligible for tax-exempt status, nonprofit organizations aren’t automatically tax-exempt. Nonprofit organizations have to apply for tax-exempt status before they can file exempt .

Tax-exempt status doesn’t mean an organization doesn’t pay any taxes. Some tax-exempt organizations may pay reduced taxes or may only pay taxes on a portion of income.

Who’s eligible for a tax exemption?

Generally speaking, certain types of nonprofit organizations are eligible for a tax exemption. Here are some of the types of organizations that can be tax-exempt:

  • Charitable organizations
  • Churches and religious organizations
  • Private foundations
  • Political organizations
  • Other nonprofits

Public schools in most states are exempt from state taxes and federal taxes, but that’s not always the case for independent institutions. For example, many private schools operate as tax-exempt organizations.

Government organizations may receive a letter from the IRS detailing their tax-exempt status. You don’t have to apply for exempt status or pay an application fee if you operate a qualified government organization.

What are tax-exempt forms used for?

Tax-exempt forms are used to apply for tax-exempt status through the IRS. Even if you qualify as a tax-exempt organization, you have to continue paying taxes until you’ve been granted tax-exempt status.

There are several different tax-exempt forms for different types of organizations. For example, social welfare organizations have to fill out different tax-exempt forms than charitable, religious, and educational organizations.

We’ll break these down in more detail below.

What are the different types of tax-exempt forms?

Applying for tax-exempt status isn’t overly complicated, but you have to fill out the right forms based on the type of organization you run. There are different tax forms based on whether you’re a 501(c)(3), 501(c)(4), or 501(a).

As we mentioned earlier, government organizations don’t have to apply for tax-exempt status. Instead, the IRS will send your organization a letter detailing your tax-exempt status.

There are also state and local tax-exempt forms you may need to fill out depending on your state and local tax laws. We’ll break down the various types of tax exemption forms below.

Based on organization

You have to fill out different tax forms depending on the type of organization you’re applying as. For example, the process for applying for tax exemption as a 501(c)(3) is different than it is for a 501(c)(4).

Charitable, religious, and educational organizations that are considered a 501(c)(3) can fill out Form 1023 or 1023-EZ to apply for tax-exempt status. Form 1023-EZ is the shorter version of Form 1023.

You can find out if you’re eligible to use 1023-EZ by completing the Form 1023-EZ Eligibility Worksheet provided by the IRS. If you answer yes to any of these questions, use Form 1023 instead of 1023-EZ.

If your organization is a social welfare organization — or 501(c)(4) — there are two tax forms you need to file. Start by filing Form 8976, Notice of Intent to Operate Under Section 501(c)(4) .

Now that you’ve filed for 501(c)(4) status, you can file Form 1024-A to apply for tax-exempt status as a 501(c)(4). It typically takes about 90 days to hear back from the IRS after applying for an exemption.

Other types of nonprofit organizations that operate under section 501(a) can complete Form 1024 to apply for tax-exempt status.

If you’re not sure which category your organization falls under, you can talk to a tax expert to make sure you’re filing the right tax forms .

Federal, state, and county tax-exempt forms

When you’re putting together your tax document checklist , don’t forget about applying for tax-exempt status on a state and local level.

The process of finding state and local tax-exempt forms will vary from state to state. You can reach out to your state’s Department of Revenue to find out which forms you need to file to be exempt from state taxes.

Most counties also have taxes, so you need to apply for an exemption from county taxes, too. You can search the name of your county followed by “tax exemption” to learn more about county-level exemptions.

If you’re having trouble finding any of these forms, you can contact your county tax office to find the forms you need. This is especially important in larger cities and counties where you pay transit taxes and other additional costs.

You can also ask a tax expert for help finding the forms you need to apply for tax-exempt status at every level.

How to find tax-exempt forms?

If you’re applying for a federal tax exemption, you can find everything you need on the IRS website. The IRS website also includes worksheets to determine your eligibility and line-by-line instructions for each tax form.

Keep in mind that it may take some time for the IRS — or state and county tax offices — to grant you tax-exempt status. You’ll usually hear back in about 90 days from when you apply, so be patient.

What about personal exemptions on individual taxes

Currently, you can’t claim a personal exemption on your taxes — even if you’re not a dependent of another taxpayer.

As part of the Tax Cuts and Jobs Act, the deduction for personal exemptions and dependents is suspended for tax years 2018 through 2025. What this means is that the current personal exemption and dependent exemption deduction is $0.

Even if you’re claiming dependents or you’re not able to be claimed as a dependent, you aren’t eligible for personal or dependent exemptions until at least the 2026 tax year.
